Welcome to IncreAI! By accessing or using our app, you agree to be bound by the following Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User" or "you") and IncreAI ("we," "us," or "our"). Please read them carefully before using our services.

IncreAI is an AI-powered application designed to provide users with engaging, witty, and sassy AI-generated responses and content for entertainment and assistance purposes. Our services may include, but are not limited to, text generation, content recommendations, and interactive features that enhance user experience.

4. Eligibility

By using IncreAI, you represent and warrant that you are at least 13 years of age. If you are under the age of 18, you may only use IncreAI under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Users suspended or removed from IncreAI are not eligible to use our services.

5. User Accounts

To access certain features of IncreAI, you may be required to create an Account. When creating an Account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use or suspected breach of security.

6. User Conduct

You agree to use IncreAI responsibly and in compliance with all applicable laws and regulations. You shall not:

  • Engage in any activity that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity.
  • Upload, post, transmit, or otherwise make available any content that you do not have a right to make available under any law or contractual relationship.
  • Use IncreAI to distribute unsolicited promotional or commercial content, spam, or other mass communications.
  • Interfere with or disrupt the integrity or performance of IncreAI or the data contained therein.
  • Attempt to gain unauthorized access to any portion of IncreAI, other user accounts, or any systems or networks connected to IncreAI.

7. Acceptable Use Policy

IncreAI is committed to maintaining a respectful and lawful environment. You agree not to generate or share content that:

  • Promotes or incites violence, hate speech, or discrimination against any individual or group based on race, religion, ethnicity, gender, sexual orientation, disability, or any other characteristic.
  • Contains sexually explicit, pornographic, or adult material.
  • Encourages or facilitates illegal activities, including but not limited to drug trafficking, human trafficking, or any form of exploitation.
  • Infringes upon the intellectual property rights or privacy rights of others.
  • Includes malicious software, viruses, worms, Trojan horses, or any other harmful or destructive content.
  • Provides unauthorized access to data, systems, or networks belonging to IncreAI or any third party.
  • Violates any applicable local, state, national, or international law or regulation.

8. Intellectual Property Rights

All rights, title, and interest in and to IncreAI and its content (excluding User-Generated Content) are and will remain the exclusive property of IncreAI and its licensors. The app is protected by copyright, trademark, and other laws of the United States and foreign countries. You agree not to use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, or otherwise exploit for any purposes whatsoever any content or third-party submissions or other proprietary rights not owned by you without the express prior written consent of the respective owners.

9. User-Generated Content

You may submit, post, or display content through IncreAI ("User-Generated Content"). You retain all rights to your User-Generated Content. By submitting content, you grant IncreAI a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User-Generated Content in connection with IncreAI's services.

You represent and warrant that you have all rights, power, and authority necessary to grant the rights granted herein to any User-Generated Content that you submit.

10. Payment and Subscriptions

Certain features of IncreAI may require payment or subscription ("Paid Services"). If you choose to access Paid Services, you agree to the pricing and payment terms. Payments are processed securely through our third-party payment processor. By making a purchase, you agree to comply with the payment processor's terms and any applicable laws and regulations.

You are responsible for providing accurate billing information and updating it as necessary. Failure to comply may result in the suspension or termination of your Paid Services.

11. Free Trials and Promotions

We may offer free trials or promotional offers from time to time. Such offers are subject to these Terms and any additional terms provided in connection with the offer. We reserve the right to modify or terminate any free trial or promotion at any time, without notice.

12. Refunds and Cancellations

All purchases are final and non-refundable unless otherwise stated in a specific refund policy. If you experience any issues with Paid Services, please contact our support team at support@increai.com. We will assess refund requests on a case-by-case basis at our sole discretion.

13. Third-Party Services and Links

IncreAI may contain links to third-party websites, services, or resources that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. By using IncreAI, you acknowledge and agree that we are not responsible or liable for any damage or loss caused by or in connection with the use of such content or services.

14. Termination

We reserve the right to suspend or terminate your Account or access to IncreAI at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use IncreAI will immediately cease. If you wish to terminate your Account, you may discontinue using IncreAI at any time.

15. Modifications to Service

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, IncreAI or any part of it, with or without notice and at our sole discretion. You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

16. Disclaimer of Warranties

IncreAI is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the availability, reliability, or accuracy of IncreAI or any content provided through the app. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by applicable law, IncreAI and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses resulting from:

  • Your access to or use of or inability to access or use IncreAI.
  • Any conduct or content of any third party on IncreAI.
  • Any content obtained from IncreAI.
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall the aggregate liability of IncreAI exceed the amount you paid to us, if any, in the past six months for the services giving rise to the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless IncreAI, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of IncreAI, including, but not limited to, your User-Generated Content, any use of IncreAI's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from IncreAI.

19. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of your country, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms shall be instituted exclusively in the federal or state courts. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

20. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of these Terms to arbitrate, shall be determined by arbitration before a single arbitrator. The arbitration shall be administered to its rules and procedures. Judgment on the award may be entered in any court having jurisdiction.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

22. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and IncreAI regarding the app and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the app.

23. Waiver

No waiver by IncreAI of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

24. Assignment

IncreAI may assign these Terms or any rights or obligations hereunder without your consent. You may not assign any rights or obligations under these Terms without the prior written consent of IncreAI. Any assignment in violation of this provision shall be null and void.

25. Force Majeure

IncreAI shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government regulations, pandemics, embargoes, natural disasters, strikes, or other labor disputes, or interruptions in telecommunications or internet services.

By using IncreAI, you consent to receive electronic communications from us. These communications may include notices about your Account, transactional information, and other information concerning or related to the app. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

27. Prohibited Business Activities

You are prohibited from using IncreAI for any activities involving:

  • The sale or promotion of physical products or services unrelated to IncreAI's offerings.
  • Human services not related to software (e.g., consulting, legal advice).
  • Payment processing without a bona fide software or service sold, including donations or crowdfunding unrelated to IncreAI.
  • Any product or service that infringes upon intellectual property rights, including unauthorized resale, illicit streaming services, or software used to bypass security measures.
  • Unauthorized access to data belonging to another party, including spyware, hacking tools, or keyloggers.
  • Adult content, pornography, or sexually explicit material.
  • Gambling, betting, lotteries, or any games of chance involving monetary or material prizes.
  • Financial services, trading platforms, money transfer services, or virtual currencies.
  • Medical or legal advice, pseudo-science services, or any form of unlicensed professional services.
  • Activities that violate any applicable laws, regulations, or our acceptable use policies.

Violation of these prohibitions may result in immediate termination of your Account and access to IncreAI, and may subject you to legal penalties.

28. Compliance with Laws

You agree to comply with all applicable local, state, national, and international laws, statutes, ordinances, and regulations in connection with your use of IncreAI. It is your responsibility to be aware of and adhere to any such laws and regulations.

29. Privacy Policy

Your use of IncreAI is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using IncreAI, you consent to the collection and use of your information as outlined in the Privacy Policy.

While IncreAI strives to provide accurate and useful content, the AI-generated responses may not always be correct, complete, or up-to-date. We make no warranties or representations regarding the accuracy or reliability of any content generated by IncreAI.

31. No Professional Advice

IncreAI does not provide medical, legal, financial, or any other form of professional advice. The content generated should not be used as a substitute for professional consultation. Always seek the advice of a qualified professional with any questions you may have regarding a specific issue.

IncreAI is accessible worldwide; however, we make no representation that the app is appropriate or available for use in all locations. Those who access or use IncreAI from other jurisdictions do so at their own risk and are responsible for compliance with local laws.
